Source<\/strong>:\u00a0Indian Centre for Human Rights And Law,\u00a0All Orissa Young Lawyers Forum \u2013Human\u00a0 Rights Law Network,\u00a0Socio-Legal Information Centre<\/p>\n Location<\/strong>: Mumbai, Maharashtra<\/p>\n Bhubaneswar, Orissa<\/p>\n New Delhi, Delhi<\/p>\n Language<\/strong>: Oriya<\/p>\n Translation<\/strong>:<\/p>\n Sexual violence at workplace<\/strong><\/p>\n What is sexual violence?<\/p>\n As per the judgment by Supreme Court on Bisakha case (Bisakha verses Rajasthan Case 13th<\/sup> August 1997) the sexual harassment is defined as,<\/p>\n any kind of unacceptable sexual behavior like :<\/p>\n a)\u00a0\u00a0\u00a0\u00a0\u00a0 Physical contact<\/p>\n b)\u00a0\u00a0\u00a0\u00a0\u00a0 Demanding for or requesting for sexual relation<\/p>\n c)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Sexually colored conversations or giving any sexual remarks<\/p>\n d)\u00a0\u00a0\u00a0\u00a0\u00a0 Showing pornography or such in writings<\/p>\n e)\u00a0\u00a0\u00a0\u00a0\u00a0 Any other non-verbal non-physical sexual conduct<\/p>\n <\/p>\n Bisakha guidelines is applicable to all such places like <\/strong><\/p>\n <\/p>\n This is applicable to all such places like government, \u00a0non-government ,organized or un-organised institutions. All salaried women and women working voluntarily in such institutions will get such benefits. As per the instruction of Supreme Court the authority of the institution will take steps to make the institution free from sexual harassment. They will make arrangements for receiving such type of complains from woman complainant.<\/p>\n How to register the complain<\/p>\n –\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Every institution will have a forum, advisor council or any other such arrangements where the affected women can go and give their complain.<\/p>\n –\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 That forum will be active in the institution. Out of total members of such forum fifty percent will be women and the forum will be headed by a woman.<\/p>\n –\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 NGOs and other individuals working on such issues should be invited to be part of such forum.<\/p>\n –\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The grievance should be addressed with a time limit.<\/p>\n –\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Secrecy of such grievance will be maintained.<\/p>\n –\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The authority of the institution will look into the affected women and her witness not be harassed further. The authority should how they will not loose their jobs.<\/p>\n –\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The forum will produce report annually and they will mention the steps taken so far for checking sexual harassment.<\/p>\n Responsibility of Head of the Institution<\/strong><\/p>\n –\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The Head of the institution should take sexual harassment cases seriously and he\/she will take immediate steps for avoiding repetition of harassment at their places.<\/p>\n –\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Head of the institution will take steps to check such harassment. The head of the institution can not his\/her ignorance of such incidents.<\/p>\n –\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Every institution will have a set of rules to check such harassment at their place.<\/p>\n Those rules will be:<\/p>\n a)\u00a0\u00a0\u00a0\u00a0\u00a0 The head of the institution will be bound to check harassment in their workplaces. He\/she will communicate all women staffs in written about the steps taken in that direction.<\/p>\n b)\u00a0\u00a0\u00a0\u00a0\u00a0 Sexual harassment is a crime – this will be communicated by the authority to all staffs.<\/p>\n c)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Fifty percent members of the forum will be women. The forum will be headed by a woman member. On any complain, the members of the forum will do investigation and will advise the authority about possible steps to check such harassment in future.<\/p>\n d)\u00a0\u00a0\u00a0\u00a0\u00a0 It will be in written that after such investigation action would be taken against perpetrator of such crime if the forum feels so.<\/p>\n e)\u00a0\u00a0\u00a0\u00a0\u00a0 The forum will define the type of punishment clearly for each type of such harassment.<\/p>\n f)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 All type of secrecy about the complain and its complainant will be maintained.<\/p>\n <\/p>\n Such set of rules must be circulated in among the staffs.<\/p>\n <\/p>\n How to prevent sexual harassment<\/strong><\/p>\n What the women staff should in such situation;<\/p>\n Myth and Reality<\/strong><\/p>\n Myth : Women love such behavior \u00a0and like such sexual remarks.<\/p>\n Reality:\u00a0 Women hate such behavior and becomes fearful after such behavior.<\/p>\n Myth :\u00a0 It is a silly matter. Women those are serious about it are not liking merry making.<\/p>\n Reality : All type of disrespect causes harm to the modesty of a woman.<\/p>\n Myth : Dress is the prime reason of sexual harassment.<\/p>\n Reality : It is foolish to say so.
